This can pose a severe financial hurdle for smaller hemp producers. Furthermore, the federal government is closing in on delta-8, and many states are scrambling to close any loopholes.

Legality in states where THC is illegal

While possession of up to half an ounce is still a felony in Georgia, the state has decriminalized cannabis use for medical purposes. However, cultivation and sale of more than that are still illegal. While possessing less than one ounce of cannabis is still a misdemeanor, it is now legal to grow and sell low-THC CBD for medical purposes. Several attempts have been made in North Carolina to legalize medical marijuana. Now, a new senate bill may make this possible.

Although recreational marijuana is still illegal in Michigan, the law is gradually improving. Michigan is now the 10th state to legalize recreational marijuana. While it is still illegal to sell up to five ounces of marijuana, a person can grow up to twelve plants and possess up to 2.5 ounces of the plant. Retail shops have also begun selling the herb. However, possessing more than five ounces is still illegal, and a conviction for a first offense carries a $500 fine.
